{"id":10205,"date":"2019-11-27T05:00:45","date_gmt":"2019-11-27T05:00:45","guid":{"rendered":"https:\/\/amabhungane.org\/?post_type=advocacy&amp;p=10205"},"modified":"2019-11-27T05:00:45","modified_gmt":"2019-11-27T05:00:45","slug":"advocacy-release-amab-and-fm-launch-application-to-access-zumas-tax-records","status":"publish","type":"post","link":"https:\/\/further.co.za\/amabwp\/advocacy-release-amab-and-fm-launch-application-to-access-zumas-tax-records\/","title":{"rendered":"Advocacy release: amaB and FM launch application to access Zuma\u2019s tax records"},"content":{"rendered":"<p>The Financial Mail and the amaBhungane Centre for Investigative Journalism on Tuesday filed papers in the Pretoria high court seeking access to the tax returns of former president Jacob Zuma and challenging the constitutionality of tax secrecy provisions.<\/p>\n<p>The papers are the culmination of a process that began in February when FM applied to Sars under the Promotion of Access to Information Act (PAIA) for Zuma\u2019s returns in the years 2010 to 2018, when he was head of state.<\/p>\n<p>The request and a subsequent appeal were denied by Sars on grounds including secrecy provisions in PAIA and the Tax Administration Act (TAA). PAIA specifically excludes tax information from its public interest considerations, while the TAA prohibits Sars and its employees from disclosing any taxpayer information to any member of the public.<\/p>\n<p>The TAA\u00a0further prevents any party, including the media, who come into possession of such information from reporting on it.<\/p>\n<p>\u201cWe believe the existing legislation to be unconstitutional, as it prevents us from obtaining information on the tax status of senior members of the executive \u2013 like former president Jacob Zuma \u2013 accused of serious crimes, including being tax delinquent. It restricts our ability to disseminate this vital information to the public,\u201d says FM editor Rob Rose.<\/p>\n<p>The former president\u2019s tax affairs have been the subject of intense scrutiny.
