Become an amaBhungane supporter <a href=\"https:\/\/amabhungane.org\/be-an-amab-supporter\/\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/em><\/i><\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The payments appear to have been kickbacks in connection with the half-a-billion-rand tender, which the city awarded in January 2019 to supply it with fuel for a period of three years.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The tender was split between three bidders including the service provider that held the existing fuel contract, Balimi Barui Trading (BBT).<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">Its owner, Hendrick Kganyago, paid R15-million to three companies linked to Malema and Dlamini between the tender being advertised in mid-2018 and last September when <a href=\"https:\/\/amabhungane.org\/stories\/tender-comrades-part-2-tshwane-tenderpreneurs-r15m-eff-tithe\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span class=\"s1\">amaBhungane exposed the payments<\/span><\/a>. The EFF\u2019s sizeable minority in the Tshwane council gave it \u201ckingmaker\u201d status.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">Kganyago\u2019s payday is set to terminate early after rival bidder Q-tique 27 brought an application to have the tender set aside. Q-tique brought the application after amaBhungane\u2019s article.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft\"><img decoding=\"async\" src=\"http:\/\/amabhungane.org\/wp-content\/uploads\/2020\/06\/Screenshot-2020-06-24-at-22.16.40.png\" alt=\"\"\/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">In the <a href=\"https:\/\/amabhungane.org\/wp-content\/uploads\/2020\/06\/Q-Tique-v-City-of-Tshwane-and-Others-Final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span class=\"s2\">slam-dunk ruling <\/span><\/a>Judge Leonie Windell cited the \u201cirrational\u201d way in which the tender was evaluated \u2013 as detailed in our expos\u00e9. Q-tique did not present evidence on the EFF payments and these were not placed in contention before the court.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">When city officials scored bidders on pricing, they did so based on six fuel types. Bidders were expected to provide prices for each fuel type, although the city, since at least 2015, only used two types of fuel \u2013 unleaded 95 and high-grade diesel.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">In its bid, BBT offered implausibly low figures for fuel the city did not use, and for the two fuels the city did use its pricing came in significantly higher than its rival bidders. \u201cBBT had gamed the system,\u201d our article said.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">In scoring the bidders\u2019 prices, the city simply totalled the figures for each fuel type and determined the aggregate price, without factoring the quantities of each fuel needed.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The judgement states: \u201cThe use of this method of evaluating the tenders on price evidently had the result that BBT was evaluated to be the bidder with the lowest price (and scoring the highest points on the aspect of price), notwithstanding that BBT\u2019s tender prices in respect of the two products that were in fact required by the City for use was by far the most expensive.\u201d<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The ruling concludes that the evaluation process was \u201cirrational and procedurally unfair\u201d and at odds with procurement policy.<\/p>\n\n\n\n<p class=\"p3 wp-block-paragraph\">It added: \u201cThe evaluation method opened the process up for abuse and corruption, in that if a tenderer knew in advance that only two of the six products would actually be purchased by the City, it would make sense to tender high in respect of those products, but very low on the other products.\u201d<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">This is precisely what BBT did. Not only would BBT have insights gleaned from its time as the incumbent service provider on the previous fuel tender, but it also appeared to have had a little help from the inside, as a <a href=\"https:\/\/amabhungane.org\/stories\/businessman-who-captured-tshwane-fleet-department-had-a-man-on-the-inside\/\"><span class=\"s1\">follow-up amaBhungane article<\/span><\/a> showed.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">Hendrick Kgyanago\u2019s brother Stanley is a city official; was listed as the contact person on the tender advertisement; and participated in the bid specification.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The judgement refrains from commenting on the conduct of the two individuals, citing an ongoing forensic investigation into the tender that was commissioned by the city.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">Windell\u2019s judgement does, however, draw attention to the city overpaying the three companies that won the tender by R10 628&nbsp;393, an amount it says is \u201ccommon cause\u201d between the parties. AmaBhungane\u2019s article had calculated even higher overpayments.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">\u201cThese overpayments only ceased after September 2019, coincidentally after an article appeared on the amaBhungane website.\u201d<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The judgement dismisses procedural claims brought by the respondents, who had argued that the application had been brought too late after the fact.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">It orders that the contracts with the three winning bidders be set aside, and declares the decision by the city to award the tender \u201cconstitutionally invalid\u201d.<\/p>\n\n\n\n<p class=\"p1 wp-block-paragraph\">The order is suspended until 31 August, presumably to give the city time to put in place new supply arrangements.
