(Oupa Nkosi, M&amp;G)<\/em><\/p>\n<p>An oil deal originally fronted by Khulubuse Zuma is being probed by US federal authorities, the latest leak to emerge from the explosive Panama Papers shows.<\/p>\n<ul>\n<li><a href=\"http:\/\/amabhungane.co.za\/article\/2016-04-08-panama-papers-originals-behind-dodgy-khulubuse-zuma-oil-deal\" target=\"_blank\" rel=\"noopener\"><strong>Read: People behind dodgy Khulubuse Zuma oil deal<\/strong><\/a><\/li>\n<\/ul>\n<p>This forms part of a wider bribery investigation into Och-Ziff Capital Management, a US hedge fund manager, about its investments in Africa.\u00a0The US justice department is pushing Och-Ziff to plead criminal guilt, <a href=\"http:\/\/www.wsj.com\/articles\/och-ziff-authorities-spar-over-bribery-settlement-terms-1460413376\" target=\"_blank\" rel=\"noopener\"> according to the <em>Wall Street Journal<\/em>.\u00a0<\/a>But its lawyers have reportedly argued that it was not criminally liable and are seeking a lesser sanction.<\/p>\n<p>The\u00a0 <a href=\"http:\/\/amabhungane.co.za\/article\/2016-04-08-panama-papers-originals-behind-dodgy-khulubuse-zuma-oil-deal\" target=\"_blank\" rel=\"noopener\">Panama Papers<\/a> have provided the first clear indication that deals involving South Africans formed part of the US authorities\u2019 probe into Och-Ziff\u2019s suspected dodgy dealings.<\/p>\n<p><a href=\"http:\/\/amabhungane.co.za\/article\/2010-07-30-zuma-incs-drc-oil-coup-and-the-tokyo-factor\" target=\"_blank\" rel=\"noopener\">In 2010<\/a>, Zuma was presented as the owner of companies to which Democratic Republic of Congo President Joseph Kabila awarded oil rights.<\/p>\n<p>Later in 2010, Och-Ziff financed the development of the oil fields through a $110m loan. Initially, the intended owners of the the companies were Israeli Dan Gertler and South African businessman Mark Willcox.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.dropbox.com\/sh\/8es3vkjkseq94td\/AACYm5juFKB8VHS6LRd-4l8qa?dl=0\" target=\"_blank\" rel=\"noopener\"><strong>Dig through our trove of documents to connect the dots yourself<\/strong><\/a><\/li>\n<\/ul>\n<p>Willcox said he never took up a shareholding.<\/p>\n<p>The oil field is 100%-controlled by Gertler, who has admitted he and Kabila are friends.<\/p>\n<p>The Panama Papers contain correspondence made in July and September last year, in which the\u00a0British Virgin Islands\u00a0attorney\u00a0general ordered law firm Mossack Fonseca to produce all records in respect of Foxwhelp and Caprikat, the companies registered in the British Virgin Island that acquired the oil rights and are controlled by Gertler.<\/p>\n<p>Under threat of a fine or imprisonment, Mossack Fonseca complied, the documents show.<\/p>\n<p>The attorney\u00a0general\u2019s correspondence indicated that the source of the request was the US probe of Och-Ziff.<\/p>\n<p>At the time of the oil deal, another of\u00a0Gertler\u2019s companies was doing business in the Congo in partnership with Africa Management, a firm at which Willcox was CEO.<\/p>\n<p>Willcox said he had no knowledge of Och-Ziff financing the oil fields and had not been contacted by US authorities.<\/p>\n<p>The Panama Papers were first leaked to German newspaper <em>S\u00fcddeutsche Zeitung<\/em>. The International Consortium of Investigative Journalists shared the documents with other journalists.<\/p>\n<ul>\n<li><a href=\"http:\/\/amabhungane.co.za\/article\/2016-04-05-the-panama-papers-exposing-the-rogue-offshore-finance-industry\" target=\"_blank\" rel=\"noopener\"><strong>Read our Panama Papers special report<\/strong><\/a><\/li>\n<\/ul>\n<p>In 2010, Zuma signed the contracts for Foxwhelp and Caprikat. He also travelled with Willcox to Kinshasa for talks about the oil field. At the time, Zuma said that his uncle, President Jacob Zuma, played no role.<\/p>\n<p>Willcox\u2019s lawyer, Rael Gootkin, said his client\u2019s role &#8220;was after the allocation of the rights \u2026 to utilise his expertise in capital raising and introducing oil majors as partners&#8221;.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.dropbox.com\/sh\/fnfw3g2vltevgiq\/AACjMEeGeREtiSLn7EoW9gFca?dl=0\" target=\"_blank\" rel=\"noopener\"><strong>Curious about Khulubuse Zuma&#8217;s involvement in an oil deal in DRC?
