{"id":4840,"date":"2017-06-30T00:00:00","date_gmt":"2017-06-30T00:00:00","guid":{"rendered":"https:\/\/amabhungane.org\/amabhungane\/stories\/leaked-records-show-that-public-funds-were-laundered-from-the-free-state-project-via-dubai-to-pay-for-the-familys-showcase-wedding\/"},"modified":"2024-09-22T20:49:01","modified_gmt":"2024-09-22T20:49:01","slug":"guptaleaks-the-dubai-laundromat-how-millions-milked-from-free-state-government-paid-for-sun-city-wedding","status":"publish","type":"post","link":"https:\/\/further.co.za\/amabwp\/guptaleaks-the-dubai-laundromat-how-millions-milked-from-free-state-government-paid-for-sun-city-wedding\/","title":{"rendered":"#GuptaLeaks: The Dubai Laundromat \u2013 How millions milked from Free State government paid for Sun City wedding"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">By all accounts, the 2013 Sun City nuptials of the Guptas\u2019 niece, Vega, was a&nbsp;dazzling display of the family\u2019s wealth.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"http:\/\/amabhungane.org\/wp-content\/uploads\/2018\/07\/Estina-graphic-1-final-e1531649471145.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Except it was not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The #GuptaLeaks reveal that that the Free State provincial government largely picked up the tab for the \u201cevent of the millennium\u201d, as it was described by a guest, KPMG Africa then-chief executive Moses Kgosana.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMy wife and I were privileged to attend and enjoyed every moment and every occasion,\u201d Kgosana <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/140402emailfromkpmgcekgosanatoatulgupta.pdf\" target=\"_blank\" rel=\"noopener\">gushed<\/a> in a thank-you note to Atul Gupta. \u201cI have never been to an event like that and probably will not because it was an event of the millennium.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Surely, though, the long list of political and business figures attending the multi-day spectacular were not privy to the veiled source of funds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Except KPMG\u2019s Kgosana should have been.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KPMG were the auditors of the Guptas\u2019 Linkway Trading (Pty) Ltd. This company, we shall see, played a crucial role in the diversion of cash earmarked for the Free State\u2019s Vrede dairy project to reimburse most of the wedding expenses \u2013 R30 million to be exact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By allowing Linkway to account for the wedding as a \u201cbusiness expense\u201d, KPMG further ensured that the Guptas paid zero taxes on their Free State government windfall.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">(See also: <a href=\"https:\/\/amabhungane.org\/stories\/guptaleaks-the-dubai-laundromat-how-kpmg-saw-no-evil-at-the-sun-city-wedding\/\" target=\"_blank\" rel=\"noopener\">The Dubai Laundromat \u2013 How KPMG saw no evil at the Sun City wedding<\/a>)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KPMG said this week it was normal for it to attend \u201cclient related events\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn this case the wedding attendance was approved by our risk management and the accommodation costs were borne by KPMG\u2026We stand by our work done and audit opinions issued.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Gupta family did not respond to our <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/170627amabhunganetogupta-amabhunganequeryvrededairycashroutedthroughdubaiandbackintoguptapockets.pdf\" target=\"_blank\" rel=\"noopener\">enquiries<\/a>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Gupta Radical Economic Transformation, courtesy Mosebenzi Zwane<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">AmaBhungane first revealed in 2013 how the Free State provincial government had gifted an unknown company, Estina, a free 99-year lease to a 4 400-hectare farm outside Vrede. Estina\u2019s sole director was an IT salesman with no farming experience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government also promised Estina R114-million a year for three years to set up a farming operation and dairy, whose supposed purpose was to empower locals and boost provincial agriculture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mosebenzi Zwane, now South Africa&#8217;s mineral resources minister and then Free State MEC for agriculture, <a href=\"https:\/\/amabhungane.org\/stories\/free-state-dairy-project-damned-in-treasury-investigation\/\" target=\"_blank\" rel=\"noopener\">drove the provincial government<\/a> to adopt the dairy project. Vrede is Zwane\u2019s home town. The project was not put out to public tender.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zwane, among the Guptas\u2019 most ardent defenders, <a href=\"http:\/\/ewn.co.za\/2017\/06\/21\/guptaleaks-mosebenzi-zwane-condemns-attacks-on-govt-staff\" target=\"_blank\" rel=\"noopener\">recently claimed<\/a> the #GuptaLeaks were an attack on committed government employees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zwane did not respond to our <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/170627amabhunganetozwane-mediaqueryvrededairymoneylaunderedthroughdubaitopayforguptawedding.pdf\" target=\"_blank\" rel=\"noopener\">enquiries<\/a> made earlier this week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2013, amaBhungane <a href=\"https:\/\/amabhungane.org\/stories\/guptas-farm-cash-cows-in-free-state\/\" target=\"_blank\" rel=\"noopener\">established<\/a> that Estina had an address that was also used by Gupta companies and that Kamal Vasram, its sole director, had ties to the Guptas. Despite these signs of Gupta involvement, the family denied any connection save for a R138 000 consulting contract performed by Linkway Trading \u2013 coincidentally or not the same company that features in this story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vasram repeated the Gupta line that the controversial family was not involved, telling amaBhungane at the time: \u201cI wish to categorically state that they are not involved in any manner in this project.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The #GuptaLeaks have unravelled these denials. Dozens of e-mails and other records show the family not only had significant control over the scheme, but diverted much of the provincial government\u2019s funding to it for&nbsp;their own purposes.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>The Guptas\u2019 Dubai laundromat milks the Free State<\/strong><\/h5>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"http:\/\/amabhungane.org\/wp-content\/uploads\/2018\/07\/IMG_3534.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">When Zwane\u2019s successor as agriculture MEC, Mamiki Qabathe, <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/131115daquesttofsagricmec-ocr.pdf\" target=\"_blank\" rel=\"noopener\">answered questions<\/a> about the project in the provincial legislature in November 2013, she said that by then a total of R114-million of the government\u2019s money \u2013 tranches of R30-million and R84-million \u2013 had been transferred to Estina. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Financial records in the #GuptaLeaks show that over a six-week period between August and September 2013, Estina had <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/dubaitransactionsummaryestinatransfersnotedinblue.pdf\" target=\"_blank\" rel=\"noopener\">transferred<\/a> US$8 348 700 (R84-million at the time) to the Dubai bank account of a Gupta-controlled United Arab Emirates (UAE) shell company, Gateway Limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is, the entire R84-million second tranche transferred by the Free State government to Estina landed in a Gupta-controlled US dollar account at Standard Chartered Bank in Dubai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a clear sign that Dubai was little more than a laundry stop, a forensic examination shows that at least three quarters of that money was shortly bounced back to two Gupta companies in South Africa \u2013 including to pay for the wedding. It went like this:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"http:\/\/www.sundayworld.co.za\/news\/2013\/04\/14\/gupta-s-go-large-multi-million-rand-affair-on-4-day-wedding\" target=\"_blank\" rel=\"noopener\">wedding celebrations<\/a> were held at Sun City over four days at the end of April and beginning of May 2013.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three months later, on July 31, the Guptas\u2019 Linkway Trading, based in South Africa, presented Accurate Investments Ltd, a second Gupta-controlled shell company in the UAE, with a four-page, itemised <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/130731weddinginvoicelinkwaytoaccurate-costofsalesva.pdf\" target=\"_blank\" rel=\"noopener\">invoice<\/a> for expenses for the \u201cV &amp; A Function \u2026 at Sun City\u201d (the bride and groom were Vega and Aakash).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The items for which Linkway invoiced Accurate for ranged from R13 086 for chocolate truffles to R2.3-million for scarves, R247 848 for fireworks and R13.9-million for \u201cevent services\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Including VAT, Linkway\u2019s bill totalled a perfectly round R30 000 000. It was further noted that \u201cthis invoice is the equivalent of USD3 333 400\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As of the date of Linkway\u2019s invoice, Accurate had a mere US$15 811 in its account at Standard Chartered \u2013 a tiny fraction of the amount invoiced. But thanks to the Free State government and Estina, Accurate\u2019s bank balance would soon improve drastically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the laundromat started spinning. If the details are confusing, it is because they were meant to, but it went like this:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>On August 11, 2013 Estina transferred US$1 999 975 of the Free State government\u2019s cash to the Standard Chartered account of the Guptas\u2019 Gateway Limited in Dubai.<\/li>\n\n\n\n<li>On the same day Gateway transferred US$1 600 000 of the Estina money to the Standard Chartered account of yet another Gupta UAE shell, Global Corporation LLC.<\/li>\n\n\n\n<li>The next day, 12 August, Global transferred US$1 590 000 \u2013 that is the full amount it received less $10 000 \u2013 in two tranches to another Standard Chartered account: that of Accurate, the company that Linkway had invoiced for the Sun City wedding.<\/li>\n\n\n\n<li>That same day, Gateway itself transferred the balance of the funds it had received from Estina plus another $25 to round it off \u2013 US$400 000 \u2013 to Accurate\u2019s Standard Chartered account.<\/li>\n\n\n\n<li>The end result of this financial Three-card Monte was that the Guptas\u2019 Accurate now held US$1,990,000 of the US$1 999 975 of the Free State government\u2019s cash, which had been transferred by Estina to Gateway the day before.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Accurate then immediately <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/130812swiftpaymentfromaccuratetolinkwayweddingexpenses.pdf\" target=\"_blank\" rel=\"noopener\">transferred<\/a> US$1 986 000 to Linkway\u2019s account at the State Bank of India in Johannesburg. The wire transfer confirmation notes an invoice number identical to the one contained in Linkway\u2019s wedding expense invoice presented to Accurate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This 12 August payment of the Free State\u2019s cash via Dubai, however, fell short of Linkway\u2019s invoiced amount of US$3 333 400 by US$1 347 400.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Wash, rinse, repeat<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">And so, the Dubai laundry machines started spinning again:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>On September 5, 2013, the next tranche of Free State funds arrived from Estina in Gateway\u2019s Dubai account: US$2 999 975.<\/li>\n\n\n\n<li>Four days later, on September 9, Gateway transferred US$1 400 000 of this cash to Accurate, which then immediately paid Linkway exactly US$1 347 400 \u2013 the balance of the wedding expense invoice.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The wedding bill, however, was not the end of the Guptas\u2019 Free State gravy train.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Weeks later, on September 23, a further US$3.1-million of the Free State\u2019s cash was washed and delivered to the Guptas in South Africa via Dubai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This time, the cash flowed from Estina to Gateway to yet another Gupta UAE front, Fidelity Enterprises Limited, which then transferred US$3.1-million to Oakbay Investments, the Gupta family holding company in South Africa.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With so much of the Free State\u2019s money ending up with the Guptas, it appears that very little ended up with actual suppliers to the project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As we <a href=\"https:\/\/amabhungane.org\/stories\/guptaleaks-despite-denials-free-state-dairy-farm-was-huge-cash-spinner-for-guptas\/\" target=\"_blank\" rel=\"noopener\">previously reported<\/a> US$3 448 800 (about R34-million then) of the R84-million that was sucked from Estina to Dubai in August and September 2013 was justified by a Gateway invoice for a milk pasteurisation plant to be supplied by <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/120219letterfromstarengineerstoajaygupta.pdf\" target=\"_blank\" rel=\"noopener\">Star Engineers<\/a>, an engineering firm in the Guptas\u2019 hometown of Saharanpur, India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">#GuptaLeaks financial records, however, show only a tiny fraction of that &#8212; US$165 610 \u2013transferred to Star Engineers during the course of 2013. Whether that was the full amount paid to Star remains unclear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Back-to-back transfers like those seen in the Guptas\u2019 Dubai accounts were obvious red flags. Indeed, Standard Chartered <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/170629standardcharteredresponsetoquestions.pdf\" target=\"_blank\" rel=\"noopener\">confirmed<\/a> this week that it closed the accounts in early 2014, shortly after these transfers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A spokesperson for the bank said: \u201cStandard Chartered takes its responsibility to combat financial crime very seriously and is fully committed to doing business in accordance with local and international regulatory and legal requirements.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By the time Estina was kicked off the project in 2014 following a national treasury probe and amaBhungane\u2019s exposure of dead cows being dumped in a ditch, the provincial government had paid Estina about R210-million in taxpayers\u2019 money.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of that, it is now clear, the Guptas, and not the people of the Free State, were the major beneficiaries.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Zwane\u2019s continuing committed public service<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Amidst the #GuptaLeaks revelations, Mineral Resources Minister Mosebenzi Zwane recently unveiled controversial changes to the mining charter. The proposed revisions seem to fit one particular family of Indian immigrants like a glove.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Naturalised black people would now also be deemed to have been previously disadvantaged by apartheid, thereby radically transforming the Guptas into prospective BEE partners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Guptas started arriving in South Africa mere months before the 1994 elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Zwane appears to have repeatedly bent over backwards for the Guptas \u2013 even going as far as suggesting the #Guptaleaks were driven by anti-black <a href=\"http:\/\/www.news24.com\/SouthAfrica\/News\/guptaleaks-are-an-attack-on-me-because-i-am-black-zwane-20170620\" target=\"_blank\" rel=\"noopener\">racism targeting him <\/a>\u2013 the leaked documents suggest that perhaps Zwane\u2019s apparent blind loyalty to the Guptas is not entirely reciprocated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Considering the colossal quantum of cash diverted from Zwane\u2019s Vrede dairy project to the Gupta\u2019s pockets, one would assume that Zwane was the Guptas\u2019 guest of honour at the Sun City extravaganza.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rather, he appears to have been an afterthought.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Possibly no other document in the #GuptaLeaks trove was circulated as widely and revised so often as the wedding\u2019s guest list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, on the near-final <a href=\"http:\/\/cdn.mg.co.za\/content\/documents\/2017\/06\/30\/weddingguestlist.pdf\" target=\"_blank\" rel=\"noopener\">guest list<\/a>, Zwane\u2019s name \u2013 a seemingly late addition near the very bottom (at row 242 out of 254) appearing under the subheading \u201cExtra Guests\u201d \u2013 was misspelled as \u201cMosebebi\u201d, an error which endured throughout the drafts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even the Guptas\u2019 <a href=\"https:\/\/www.businesslive.co.za\/bd\/opinion\/columnists\/2017-06-29-peter-bruce--the-price-of-writing-about-the-guptas\/\" target=\"_blank\" rel=\"noopener\">now-mortal enemy<\/a>, Peter Bruce, the former editor of <em>Business Day<\/em>, snagged a higher spot (235) than Zwane on the guest list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the fate of the mining charter revisions recently tabled by Zwane is uncertain, one thing is clear: with the next generation of Guptas now in their teens and twenties, weddings (and wedding expenses) will continue apace.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For all his steadfast efforts to radically economically transform the Guptas, perhaps \u201cMosebebi\u201d should at the very least demand pride of place at the next one.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"http:\/\/www.amabhungane.co.za\/\"><em><strong>The amaBhungane Centre for Investigative Journalism<\/strong><\/em><\/a><strong><em> is an independent non-profit.
