Help us do more. <span style=\"text-decoration: underline;\"><a href=\"https:\/\/amabhungane.org\/be-an-amab-supporter\/\" target=\"_blank\" rel=\"noopener\">Be an amaB Supporter<\/a>.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The multinational IT giant released the findings of the investigation by law firm Baker McKenzie into allegations that SAP paid more than R100-million in kickbacks to Gupta-owned companies in order to secure six deals with Transnet and Eskom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AmaBhungane and Scorpio first <a href=\"https:\/\/amabhungane.org\/stories\/guptaleaks-software-giant-sap-paid-gupta-front-r100m-kickbacks-for-state-business\/\" target=\"_blank\" rel=\"noopener\">exposed the R100-millon payments<\/a> last July.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klarmann joined Adaire Fox-Martin, the SAP executive board member in charge of the investigation, in a conference call with amaBhungane earlier today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although SAP said it found \u201cno evidence of payments to Eskom or Transnet employees or to any government officials in South Africa\u201d, both Fox-Martin and Klarmann conceded that they have been left with many suspicions and unanswered questions about how three minor IT companies with connections to the Guptas \u2013 Global Softech Solutions (GSS), CAD House and Lejara \u2013 became major dealmakers on contracts SAP scored with state-owned entities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere were absolutely irregularities in the management of third parties\u201d \u2013 i.e. Gupta companies acting as sales agents \u2013 \u201cand to the adherence of compliance to SAP\u2019s processes in South Africa,\u201d Fox-Martin confirmed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the big questions, for instance, is whether executives in South Africa disclosed the political connections of their newly-signed \u201csales agents\u201d, which stood to earn between 10 and 14.9 percent of the value of every deal they facilitated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are surprised that given the prominence of the Guptas in South Africa, and maybe the surroundings and rumours, we are a bit surprised that SAP leaders are meeting with representatives of the Guptas and are not telling [that these companies are associated with the Guptas],\u201d Klarmann said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt happened but not in the correct manner and also not at the correct time we believe. Even in some of the companies it was not told at all.\u201d<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">The hidden hand of the Guptas<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Another unanswered question is what the Gupta-controlled companies did in order to secure the contracts with state-owned entities. In the case of CAD House, for instance, its tasks included to meet with and lobby Transnet chief financial officer Garry Pita ahead of a crucial decision on whether Transnet should sign a R114-milion IT contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to get paid, companies like CAD House and GSS were required to provide SAP with a \u201ccomplete and accurate description of the work done\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe have seen descriptions and we have seen documents \u2013 we have question marks to some of this to be honest. We have doubts about some of the services that apparently have been performed or some of the deliverables that have been mentioned. We have doubts that these are accurate,\u201d Klarmann said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the alleged meeting with Pita \u2013 which Pita denies \u2013 Klarmann said: \u201cWe could not establish that.\u201d<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Read <a href=\"https:\/\/amabhungane.org\/wp-content\/uploads\/2019\/01\/SAP_SouthAfricaKeyFindings.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">key findings<\/span><\/a> and the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/amabhungane.org\/wp-content\/uploads\/2019\/01\/FINAL_Press_Release_South_Africa_Investigation_EN.pdf\" target=\"_blank\" rel=\"noopener\">press release<\/a><\/span>.<\/strong><\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\">The R500m Lead2Cash deal<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Questions also remain about how Gupta-linked companies were selected as so-called supplier development partners, putting them in line for multi-million rand contracts with Transnet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2016, <a href=\"https:\/\/amabhungane.org\/stories\/gupta-linked-company-set-to-score-r800-million-in-transnet-it-solution-tender-deal\/\" target=\"_blank\" rel=\"noopener\">amaBhungane reported<\/a> on a failed bid by SAP to secure a R800-million deal with Transnet. The Lead2Cash project would have involved sub-contracting 60 percent of the project to a little-known Gupta-owned company, GSS, as its supplier development partner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Had the deal gone through, GSS would have received roughly R500-million.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But did GSS, whose total revenue for the previous year was R53-million, have the skills to do the job?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere are conflicting messages about this during the investigation. That\u2019s all I can say. We have conflicting messages from our own people and from others about these capabilities that you mention,\u201d Klarmann says.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Three executives walk<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Finding conclusive answers seems as three implicated senior SAP executives have resigned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although SAP refused to name the employees, amaBhungane has established that Lawrence Kandaswami, the managing director of SAP South Africa, and Deena Pillay, the chief financial officer of SAP South Africa, resigned late last year while Brett Parker, the managing director of SAP Africa, resigned last month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese executives categorically received no severance from SAP,\u201d Fox-Martin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, amaBhungane understands at least one of the executives had received an annual bonus equal to about six months\u2019 income. Asked about this, Fox-Martin said: \u201cWe have an obligation to pay what is due and that is the minimum that we paid.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere are legal limitations to what you can do and we had to do it,\u201d Klarmann added.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Investigations \u201cstill ongoing\u201d<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">SAP is entitled to conduct an audit of the companies it signs as sales agents if it suspects that commissions were on-paid to government officials or politicians. Although SAP\u2019s release states that no such payments were made, SAP also conceded that the audits of these companies were still ongoing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[F]rom what we have seen in the audit already we have not seen any such payment,\u201d Klarmann said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[T]here are limitations to what we as SAP can achieve in a complex investigation without having the investigative power of government authorities,\u201d Fox-Martin said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also still ongoing is SAP\u2019s investigation into other public sector contracts, including a lucrative contract it received from the department of water and sanitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February last year, the Economic Freedom Fighters (EFF) published whistleblower allegations that at least R35-million in kickbacks was paid to secure this contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the time, SAP\u2019s Brett Parker dismissed the claims as \u201cfactually incorrect and unsubstantiated\u201d. SAP now says these allegations are \u201cstill under investigation\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFor us at SAP this has been a deeply humbling and humiliating process.
